If you are specifically talking about Google Photos, and not data in general:

Please first check your trash. Open Google Photos > Library > Trash. If your photo is there, select the item and then select restore.

If a deleted photo isn't in trash, you can't restore it. You won't be able to restore a photo if:

You moved it to trash more than 60 days ago.
You moved it to trash, then emptied your trash.
You permanently deleted it from your trash.
You permanently deleted it from your device's Gallery app without backing it up first.

If the files were on your phone's local storage, you can decide if a data recovery application would be useful. Welcome to Google Photos Community.
 
Open the Google Photos app, click on your profile > photos settings> Backup & Sync and disable the backup toggle.
 
By performing the above steps Then nothing will be backed up on Google photos.

To check accurately, were your photos uploading to Photos, check the files from the browser https://photos.google.com and compare - all your files are already in Photos? If all the files are inside, then you can be sure that all of your files will be saved to Google Photos.
Service Photos recognizes duplicates, and does not upload those files that it already has.

That's hardly possible and too complicated, but it is not clear what you mean with "old photos". 
If you install the Google One app for free, you can download 200 recent photos back into the Restored-folder. The rest can be viewed in the Google Photos app. 
 
PS: blame Google via the feedback option under your profile that they were not clear what was going to happen, because everyone falls in the same pit since years and we can't make that clear.
