House Judiciary Committee Hires Trump Legal Critics for Investigations The New York Times

WASHINGTON — Democrats on the House Judiciary Committee said on Tuesday that they have retained two elite white collar litigators and prominent legal critics of President Trump to help begin inquiries into some of the most sensitive allegations involving the president, including ethics violations, corruption and possible obstruction of justice.

The committees chairman, Representative Jerrold Nadler of New York, has not committed to opening a formal impeachment inquiry, but the addition of the two lawyers, Norman L. Eisen and Barry H. Berke, indicates that the Democrats do not intend to wait for the special counsel, Robert S. Mueller III, to finish his work to begin weighing issues that could ultimately be wrapped up in such a proceeding.

The President of the United States faces numerous allegations of corruption and obstruction, Mr. Nadler said in a statement announcing the decision. His conduct and crude statements threaten the basic legal, ethical, and constitutional norms that maintain our democratic institutions. Congress has a constitutional duty to be a check and balance against abuses of power when necessary.

Mr. Nadler gave little detail about those inquiries in his statement, saying that Mr. Eisen and Mr. Berke would consult on matters related to the Department of Justice, including the Departments review of Special Counsel Muellers investigation. A Judiciary committee official, who was not authorized to discuss the appointments publicly, said that Democrats would be rolling out more detailed plans in the coming weeks.

Mr. Eisen and Mr. Berke are arguably the highest profile legal hires yet by House Democrats as they prepare for those inquiries and others.

Mr. Eisen, 58, served as the top White House ethics lawyer under President Barack Obama and later as his ambassador to the Czech Republic. A former white collar litigator and investigator, he has emerged since Mr. Trumps election as one of the presidents most recognizable legal critics, using his perch as chairman of Citizens for Responsibility and Ethics in Washington to write voluminously about what he has argued are ethical lapses and instances of outright corruption in his administration.

Mr. Eisen also serves as a co counsel in a lawsuit accusing Mr. Trump of violating the emoluments clause of the Constitution by refusing to divorce himself from his businesses.

Mr. Berke, a partner at the New York firm Kramer Levin Naftalis Frankel, is less well known in Washington, but has with Mr. Eisen about obstruction of justice and the presidents other legal vulnerabilities. He has extensive experience with complicated financial and tax crimes cases.

As House committees launch an array of new inquiries into Mr. Trump, his administration and his businesses, the Judiciary Committee is likely to emerge as a crucial arbiter of Mr. Trumps political fortunes. It has oversight of the Justice Department and F.B.I. and traditionally has been the venue where impeachment proceedings begin.

Despite considerable pressure from his left flank, Mr. Nadler has thus far approached the impeachment question cautiously, saying repeatedly that he does not yet see a case and wants to wait for Mr. Mueller to finish his work before proceeding to any formal deliberations.

But he has made some of his views clear.

In recent weeks, Mr. Nadler has said publicly that he believes Mr. Trump has engaged in a long pattern of obstruction and views his attacks on federal law enforcement as an existential threat to those institutions. He has said in the past that he also plans to investigate Mr. Trumps role in making hush money payments shortly before Election Day in 2016 to two women who said they had affairs with Mr. Trump. The presidents former personal lawyer, Michael D. Cohen, implicated Mr. Trump in those payments in court last year as he pleaded guilty to a campaign finance violation and others.

Mr. Eisen and Mr. Berke, together with Noah Bookbinder, the executive director of C.R.E.W., have written on obstruction of justice, collusion and Mr. Trump for the Brookings Institution.

In many ways, the question has become less about whether there is a case that Donald J. Trump obstructed justice, and more about whether and in what form the rule of law will be followed, last August.

and defend the president.

And the only way he knew how this is what hume tweeted.

Geez.

So, Brit Hume is essentially out there telling us that Donald Trump is too stupid to make

a genocide joke because he doesn't understand anything.

Well, at that point, almost like a superhero incomes, Captain America, Chris Evans himself

who tweets out the following in response to Brit humes, horrible defense of the president

of the United States.

Your defense is that he's too uneducated to have made this offensive remark.

Also, can you imagine if another president admitted to not knowing what the trail of

It was perfect, and it touched on everything that is wrong with the Trump presidency itself.

today.

They, they did it with George W dot Bush.

They laughed it off.

They laugh it off with Pailin and Bachmann and all of the others.

And that's not okay.

We've seen the damage that that can do here in the United States.

We're living under it when you enact policies because you know nothing about political process

or economic process or foreign policy that damages the United States.

We're seeing it with the trade wars.

We're seeing it with their environmental policy.

We're seeing it with their foreign policy and withdrawing us from necessary treaties

and packs that we have with other countries.

So yes, Trump stupidity is damaging the United States and more importantly stopped trying

to write it off like, oh, well this guy just doesn't know history.

He just doesn't know this.

He doesn't know that that is not an acceptable excuse for anything.

And Chris Evans is 100 percent right.

If he didn't know what he was referring to, he would not have capitalize the word trail.

Yes, Donald Trump does like to randomly capitalize words here and there, but trail was in all

caps.

Why that word?

Why not see you on the campaign trail?

He picked that word for a reason and only a complete Trump suck up and sick offense

like Brett, a Brit hume would be able to look at that and try to write it off as just the

president being a moron.

He is a moron, but in this case, he knew a Maura.

This was not a random capitalization.

One hour later, one hour later, trump tweets out the following.

The Democrats are so self righteous and angry, loosen up and have some fun.

The country's doing well.

You literally an hour before you sent this to eat, called them crazy and you made up

lies about them like you do every single day.

Seriously.

Honest to God, Donald, if anybody needs to loosen up, it's probably the guy who spends

all day on twitter writing in all caps, screaming about things that aren't even real.

I don't understand what happened in that one hour, you know, between 8:00 AM and 9:00 AM,

but perhaps to Donald Trump.

Maybe get his hands on some medical marijuana or something like, hey guys, everybody just

chill for awhile.

Let's just do relax.

Democrats.

Things are awesome right now.

Those things we take very seriously and to the presidents.

Other point the country is doing well in what regard?

In what regard is this country doing?

We're not a leader in anything globally anymore except for corruption.

We're destroying our environment.

We're poisoning our own citizens.

We have one of the highest incarceration, incarceration rates of any developed country.

We can't afford healthcare.

People are dying because of it.

So how are we doing?

Well, the answer is we're not.

Everything is going down in this country and it's thanks to the policies of Donald Trump

and the republican party, so if they want us to lighten up and relax, oh, trust us,

those days are coming, but not until we finished these policy initiatives to help preserve

the future of this country that Republicans have been so happily destroying for well over

a decade.

Now, once we do that, trust me, we're all gonna.

Lighten up, loosen up and enjoy things because at that point, America really will be doing

well.
