right of Americans to free speech even when that ride has been used to

criticize us that signal is inappropriate and deeply regrettable

decisions on security clearances should be based on national security concerns

and not political views David Petraeus is one of the many who signed that you

can make a case that John Brennan's been the biggest critic of this

administration he's on TV almost every day and what the White House would argue

is that you can go ahead and talk but your access to the information will be

no longer what did Sarah Stander's tell you about that well and I asked her

about that when she made that announcement on Wednesday I asked if

this was something that would could be sitt considered or construed as an

effort to block free speech and she said no the president has a constitutional

right to protect the access to the classified information and

the headline Trump is not trying to silence Brennan that's the headline all

right the president's strategy is the opposite to make the former CIA director

more prominent and use him as a foil in other words you make Brennan the face of

the resistance is that what's going on here well I read that and I think it's

an interesting take look the President does like to have a foil he has often

used the media as a foil and the democratic party he's used Maxine Waters

is a foil he certainly elevated her by continuing to talk about her and rallies

and on Twitter certainly Nancy Pelosi as well so it's possible though that's part

of this strategy it is it would not be unprecedented for him to choose somebody

who he thinks will rile up the base by by elevating him or her and and extra

emphasizing what he or she has said that has been critical of the president do

you know of any moves expected for today well as you said before the president is

just watching to see whether and when he makes another decision to strip other

people of these security clearances I don't think this story is going away

beat great with the KKK like it's it's insane and this guy is a governor who

wants to be President but I think he wants to be president of the wrong

country because we're not electing him he's running for re-election guys skip

how does a politician cuomo known for pushing people and businesses out of the

see our economy improve right now we're seeing that there are more available

jobs than people to fill them unemployment at historic lows markets

and 401ks at historic highs the president's coming to my district here

borders to strengthen our military improve our foreign policy and to make

countries respect us again adversaries understanding that they do not respect

adversary to people in power and hold them accountable actually to a guy who

lies and lies and yourself what's the big deal yesterday in talking about John

Brennan revoking the security easkey says oh this was all about protecting

national intelligence and then he turns around tells The Wall Street Journal

which didn't run this editorial by the way The Wall Street Journal's them oh

yeah that was about the Russia investigation because he's one of the

guys who started so somebody's got to be a watchdog and called Trump on his lies

and yet you guys want a city like Britain and they tell you the danger

this over half of Republicans listening to this now say they agree with Trump

and guess what okay it invites the threat this is what one of the papers

said invites the threat of violence against people doing their job which is

to report the news the violence against what you mean when auntie Fah went after

that reporter Jessie yes I am amazed that now we're demanding that all of our

politicians tell the truth that's incredible to me because your health

care yeah and no one called him out on that oh no position against Barack Obama

they loved Barack Obama Obama joked about it the White House Correspondents

in her oh you guys are my base and everybody laughed and was drinking

champagne stop pretending like they were tough on Obama

they weren't they'd have a lot more credibility if every administration that

came around they were this adversarial but they don't and they're not that's

it reached at least three hundred editors because I swear no one would

know about this if I hadn't I'll be slightly contrarian oh no you know I

love the meat I love news I love journalism I feel like I'm adult enough

stands up and makes the story about himself versus something that is amazing

like there's some great journalism being done in Long formats at in new formats

like on podcast there's a really good stuff that else a lot of it doesn't have

anything to do with President Trump there's a lot of good stuff out there

of the press for a reason I believe in the Constitution I think our founding

fathers understood that as we've all been saying the adversarial relationship

is going to be there but it is the most important thing I don't mind if they did

the editorials it's fine it may be it doesn't have that much of an effect

except for maybe to get us riled up and but also he has gone after the media

it's pretty viciously sometimes deservedly but you know he likes to call

himself a counter-puncher what other people can be counter punchers - and if

they can counter punch with an editorial so be it I have to accept that it was a

counter punch by mob they did it together and they all sound the same he

goes it just makes him look better because he's lone and I still maintain

he's talking about fake news not the whole news can we just run what you want

an example one of the media and how they feel about Trump and how they're in

would like a pollster to test this question how many people in the

Republican Party think that it would be okay for Donald Trump to dissolve their

pretty consistent basis own it I feel like they should own it when people who

are saying that their objective journalists are repeatedly taking one

side over another that's a problem that is the responsibility of any person with

a brain and a thinking person to come out and say this is not a fair and

balanced media that doesn't mean there aren't good journalists that doesn't

mean that journalists aren't supposed to be watchdogs and that doesn't mean that

everyone in the press is terrible but there is an inherent consistent

motivated agenda driven bias in much of the media it's incumbent upon people to

call out a technology you have to admit that no I don't any by the way the

example the good the example the Greg gave us of John Heilemann John helm is

not there as a journalist he's there as a commentator and he's offering his

opinion in much the way that we do at this table we have never said anything

like that no Bob would kill your parents at the chair I won't tell you what we've

There's a piece at ABC News what happens if Mahler decides to subpoena President Trump and

they asked a bunch of

Law professors or former prosecutors and that sort of thing

Peter Shayne professor, Ohio State University

Is it smart strategy for Muller to issue a subpoena on the president?

He says that Moritz College of Law, I would say yes

because the evidence that the president could give would be in my judgment directly relevant to the plausibility of charges that

Involved not only the president but other people involved in his campaign

including family members and I think that as a prosecutor and former FBI director that Muller believes in

Dhading as many eyes and crossing as many t's as possible

I don't think he would want to leave this particular stone unturned. I have no idea what that means

None

Question the president about what involving family members

You question the family members

All right, somebody by the name of whiting

Their answer there are risks for Muller in terms of whether to seek a subpoena. The first is delay

It would be litigated and that is a fact by the way, and it would take several months to be litigated

So he'd have to decide whether and how the delay would affect his investigation and the second thing is he could lose in court

I don't think he'd lose in court but there's always a risk of losing in court and so we would have to calculate how important

It was for him to get the interview versus the risks. That's why this has dragged on for so long

Both sides are negotiating in the shadow of these risks and trying to press their positions and see who will blink first

Better not the subpoena the president because it could be litigated for 18 months or more

Muller has sufficient statements by the President to know why he did what he did that is a fact right there

There's no reason for any of this

So in my view the professor and former associate independent counsel probably knows better than the rest somebody named welly

I'm confident that what's going on inside? The Muller investigation is only remotely related to what we know about at this point

So it's a possibly he has what he needs and doesn't absolutely

Need the president's testimony so he could walk away from it or he could issue a subpoena. Well, thanks for nothing there pal

What would prompt Muller to issue a subpoena to the president is the question posed by ABC

They go to Professor Prakash of the University of Virginia

Giuliani's been all over the press about how the president wants to testify but not with the respect to all of these questions about obstruction

of justice

This has been going on for months. Perhaps Muller believes

That he just has to ask these questions and play this out to see what the president's responses

Well, that's a foolish answer back to this guy whiting Muller would have to decide either that Trump's team is not serious about sitting down

For an interview or that the conditions they are seeking to impose are so restrictive as to make the interview not worthwhile

And if Muller decides that one of those two things has happened

Then that's when he would have to make a decision about whether or not to seek a subpoena

If and when Muller decides to subpoena President Trump what happens next

Wylie that's the federal government basically saying you do this or else that's what a subpoena is

it is saying to the President of the United States if you don't comply we

The government are going to make you comply now. Listen to that. The president is the executive branch

This is an inferior employee if you listen to the so-called experts

So this inferior employee can say we can make my boss comply with this

This is what I mean the courts are playing with fire if they go along with this

it is a burden on the presidency and

That's true because he's obviously read the memos out of the Department of Justice

The reasons for objecting to the subpoena have to do with whether a president may subpoena for testimony at all

What the president's lawyers are going to say

I'm virtually certain is that the court has no authority to demand that the president give personal testimony

I think the president would then invoke executive privilege and I think the special counsel at that point would try to contest the invocation

saying it doesn't apply and therefore the president has to testify and so that would be

litigated and the court would have to decide whether the special counsel could actually contest the president's claim if they decide that he couldn't

That would be the end of the subpoena. He wouldn't be able to enforce it

If they are at an impasse and mother issues a subpoena

The president has a decision to make he can comply with the subpoena that means showing up in the grand jury and answering questions

Like any other human being who subpoenaed to testify?

Option two is the one that President Clinton chose in the 1990s, which was when he was subpoena by Ken Starr

That was when Clinton's team finally sat down and negotiated third thing

The president could do is fight you go to the court and say look, I'm the president. You can't subpoena me

I refuse to come

That fight would start in the District of Columbia with a grand jury's meeting and pretty obviously it would go all the way up to

the Supreme Court

Predict. That's what would happen

Whiting the other thing that could happen is mother could issue the subpoena and then that could start negotiations again if they see that Muller

Is willing to issue a subpoena

Then they might the risks

Then they asked how long might a court battle over subpoena take practice

President try not to comply with any order until he gets a decision from the appellate court or from the Supreme Court

The district court ordered him to testify I suspect he'd say I'm going to peel this and try to prevent the testimony from being given

Whiting certainly be expedited because this is an ongoing investigation

So there's a pressing need to resolve it

And also I think the judge would know that both sides have fully thought through their arguments and so forth rosensweig

I would expect everybody would work very hard to expedite it

There's an interesting question as the strategy because there are two elements of strategy two objectives one is winning. The other is delaying

Let me just say this folks. You can delay and win

If the subpoena fight reaches the Supreme Court who is likely to prevail and then when we're done I have a question for you

What haven't they asked over there at ABC News?

Practice unlike the Nixon case they are not asking for evidence for documents or tapes. They're asking for the president's testimony

I don't know what the court would say about trying to get the president to testify as the whether he had the requisite

state of mind for obstruction of justice

or whatever else the special prosecutors investigating and I don't know what the court would say about the applicability of

Executive privilege in that context as far as I can tell the special counsel doesn't have any explicit litigating authority to contest

presidential assertions of executive privilege

That was a feature of the regulations in place in Watergate era

It wasn't reiative for whatever reason when the Clinton administration put out these special counsel regulations

Shane I would be a little surprised if the Supreme Court were to take the position that executive privilege with regard to testimony was absolute

The accountability of any one branch of government to any other branch stop

It's not the accountability of one branch to another branch it's the same branch that's the point professor

It's the same branch. It's an executive branch

He's an inferior employee if you buy that argument if he's not an inferior employee if he's a principal employee

He's out because it violate the appointments clause

That's why he's kind of boxed in Molly

What else does he say here?

I think what's going to happen is the decision is not going to be you can never subpoena the president and it's not going to

Be you can subpoena the president just like any other citizen. It's going to be somewhere in the middle

Rosensweig in the end. My prediction is seventy five to twenty five percent that Muller wins are at this guy

I don't even know why this rosensweig is involved

then they asked if Trump could defy a court order and

That's all speculate what didn't they ask mr. Petitioner

If mr. Muller issues a subpoena

To try and force the president to testify in front of a federal grand jury

What potential damage might he do to the constitutional

So they created the appointments process and certain some certain people are elected and checks and balances and all the rest

The problem is this prosecutor has not checked or balanced

He's a cowboy

The supreme court was wrong in marzin and there be wrong now to intervene on the behalf of a special counsel

That I thought were fascinating not to predict an outcome. I'd be foolish to do that anybody would

But they weren't really clear about a few terms

Especially one that grabbed my attention

First day of jury proceedings that lasted six or seven hours or so

The jury asked a couple of questions of the court

Including what is a shelf company and a few other technical terms now?

This isn't the question that

Particularly drew my attention, but still they're asking questions like that

That means the prosecution didn't explain these technical terms or some of them

And apparently that phrase was used repeatedly

again, I I'm just giving you a sense you're sitting in a jury room and these you're asking these things and the

Prosecution has to prove its case

Beyond a reasonable doubt and each one of the charges now. They threw a zillion charges at Manafort

So they're hoping they get one two three something

or all of them

They asked other questions

They said to the court

Can you help us organize the evidence as the evidence the documentary evidence applies to each one of the charges?

Can you help us put it in order court said no, you have to do that. We don't do that. We can't do that

That's interesting

Maybe they're overwhelmed

Maybe there was too much thrown at them

Then they asked the judge and here's the one that got my attention

To define reasonable doubt

What's meant by reasonable doubt

And the prosecution and the defense counsel apparently agreed and the judge said

Well, it doesn't mean there's no possibility whatsoever

It's something less than that

What's reasonable doubt

So they're not I

Guess the defense counsel was rather pleased today because they didn't just say, okay. Let's sit down guilty guilty guilty of those

What's this phrase mean? And what's this phrase mean? And

what does reasonable doubt mean and

You know, can you help us take whatever information we're supposed to take and apply to a particular charge

You know, these are really straightforward charges, but it can get complicated

Bank fraud and tax fraud

Now here's the truth what usually happens in a case like this

Is there isn't a case like this

Because the first thing that usually occurs in this process is there is an extensive IRS audit

It could go on for years

The IRS sits down with your accountants your accountants go through everything the IRS

issues their own

investigative subpoenas, they gather information

whether it's on wires or whatever it is, why are moving of money and so forth and so on and

And it can go in various directions

But typically it doesn't go straight in to a criminal prosecution

Like this

I'm just telling you the truth

There are criminal prosecutions in tax cases a bank fraud cases. That's quite obvious

But typically it's not the first shoe to drop

And I'll give you further evidence of that remember

The FBI was aware of a number of these foreign bank accounts

In 2015 and 2016. That's just two and three years ago

During the course of another investigation they aware them they asked about them and they moved on

They moved on

Now that's pretty remarkable, isn't it?

If in fact you're talking about these massive sums of money

ripping off the American

Government and the federal treasury and so far. Why would they just move on?

Why would they slow down and say you know what let's really dig into that but they didn't really dig into that

It's almost as if they dusted off this old matter

They decided to make a

bigger push on it

Because of who Manafort us again, I'm no special Pleader ladies and gentlemen, these Gilley's guilty, but that's not my point

And you could tell the judge from day one wasn't really happy about this case like why you're focused on this guy

You're the special counsel

obviously you wanna you want to beat him down and and keep something else in mind if they get a conviction on one count to

Count 10 count whatever it is

They're still gonna go back the prosecutor and say I give us something

It maybe will we'll fight to reduce the sentence you can still plea you know

That is in terms of your sentence you can still cut a deal

And then you have the other trial hanging over man afraid in Washington DC

in front of a liberal Obama judge, so they're thrilled about that the prosecutors but what I said earlier was this

Again maybe they'll get a conviction on all counts. That's not my point. What I said was this

this was a sloppy prosecution a

Very sloppy prosecution if in fact the documents are enough to convict as

The prosecution said in its closing argument yesterday

Plus if you have witnesses accountants

Bank officials bank employees and so forth. Why would you put gates on the stand?

You knew Gates was gonna be filleted you knew he was gonna be hammered

You know, he's a serial liar and he's a crook even cheated Manafort his friend and his boss

You know, he's a reprobate who has no character

And my buddy Andy McCarthy points out another thing with respect to this guy what he says

They were charging

gates with counts that added up to over a hundred years in prison and

the deal they cut with Gates's effective to relatively minor counts a

Maximum potential of ten years in prison with a likelihood of serving no time

You go from a hundred years to zero. Well, that should raise eyebrows. You're that desperate to have this witness is

That equal justice ladies and gentlemen, no

And

Yet defense counsel

Shoot him up pretty well. Really I

think I

Wasn't there every day? I didn't hear every argument wasn't there any day?

so again, I'm reading the the news accounts some of which are better than others and

You don't get a sense of how the jury reacted, you know not being in the courthouse

But it's very interesting to me that the jury comes back with a number of technical questions, well, what does this mean

What does this mean? Well these shelf corporations. I

Won't say that was the heart of the case

But it was certainly significant

You're setting up these companies in order to they argue launder money through them overseas

What's a shelf corporation

And what's

reasonable doubt and

How do we match up all this evidence with?

With the various charter, how do we make sure this evidence applies to this charge in this charge and so forth and so on?

So, I don't know what to make of this other than

and

Again, we don't know but if you're the prosecution you have to be a little nervous of your defense counsel

You have to be not happy, but you have to be somewhat

pleased

Because it's up to the government to make the case the government has to make the case

It's not up to the defense to make the case

The government has to make the case that this guy committed these serial crimes. He did it with intent and

the test is

Reasonable doubt

2007 and 2016 large American companies dedicated

93% of their earnings to shareholders. Where does that come from?

75% of the rector's and shareholders would have to sign off on decisions to spend money on politics. I

Thought we lived in America I thought if you start a business and you start a company

It becomes wildly successful and you ploy all kinds of people and provide products and services that people want that's a good thing

But apparently it's not good enough for

The past 30 years she wrote we've put the American stamp of approval on giant corporation. No, no. No we haven't

We've put the American stamp of approval on massive government

She writes even as they have ignored the interests of all but a tiny slice of Americans

We should insist on a new deal

This of course would be a pickaxe at the heart of capitalism

And the funny thing about these big companies any of us can own a piece of them any of us can invest in them

She would take the assets and resources of a corporation and say okay

You got to give to the community. Well, what does that mean?

The annual report that Congress released today highlights China's growing military

economic and diplomatic cloud and how Beijing is leveraging this to rapidly bill its

International footprint and established regional dominance in the case of China's air power the report states that Chinese bombers are developing

Capabilities to hit targets as far from China as possible

Over the last three years the People's Liberation Army the PLA. Yeah, right

The People's raishin army has rapidly expanded its overwater bomber

Operating areas gaining experience in critical maritime regions and likely training for strikes against u.s

And allied targets the document states noting how China is pushing its operations out into the Pacific

In August 2017. That's a year ago six Chinese

h6k bombers

Flew through them Miyoko straight in the southwest of the Japanese islands

and then for the first time turned north to fly east of Okinawa where

47,000 US troops are based

the PLA may demonstrate the capability to strike us and allied forces and military bases in the western Pacific Ocean including

Guam which is an American territory. Those are American citizens

The report says

largest ground force China is engaged in a decades-long build-up and

modernization of its once backward Armed Forces and military leaders have set a goal of filling a world-class military by

2050

President Gigi ping last year ordered the PLA to step up efforts saying China needed a military ready to fight and win wars

The call has alarmed China's neighbors

Several of whom are embroiled in tense border disputes with the superpower

See now China's a superpower wasn't a superpower five years ago

According to the Pentagon the PLA in April 2017 undertook a massive transformation of

Operational tactical units as part of its structural reforms with nearly 1 million troops

The PLA is the largest standing Ground Force in the world

The report notes that the purpose of these reforms is to create a more mobile

Modular lethal ground force capable of being the core of joint operations

And able to meet GG pings directive to fight and win wars

China's military budget for 2017 was about

190 billion dollars according to the report far behind the Pentagon's annual budget of about

$700 now, that is an absurd comparison

Their soldiers are conscripts. They're not volunteers for the most part. They pay them nothing

They pay their families nothing they have minimal health care

That I'll go on when the Pentagon released its annual report last year Beijing dismissed it as irresponsible and

predicting that China would expand its global military presence by building overseas bases in countries, like

Pakistan

This year's report reiterates that China will seek to establish new bases in countries such as Pakistan

key to this expanding footprint is

China's belt and road initiative that seeks the bolster ties with other nations through LEED lending and

infrastructure deals

The document also shines a light on China's ongoing military preparations for a contingency in the Taiwan Strait. You know what that means?

They intend to invade Taiwan

Officially China advocates for a peaceful reunification with Taiwan, but it has never repudiated the use of military force the document notes

the PLA also is likely preparing for a contingency to unify Taiwan with China by force by

simultaneously deterring delaying and denying any third party intervention on Taiwan's behalf at States and

should the United States intervene China would try to delay effective intervention and seek victory and a

high-intensity limited war of short duration

In other words quick and hard everything they have fast

To the ire of regional neighbors China has built a series of eyelets as you know

But he can't be prosecuted right because he's the president so I think that's what that was

as a liar Peter Doocy is live at the federal courthouse in Alexandria

Virginia with all of the latest Peter Lisa the jury this morning at the judge

for a sort of change of venue they thought the jury room was too small to

deliberate so they asked if they could do it in the break room instead the

judge said that they could and that is where they are right now this is the

first day of deliberations and the judge TS Ellis wanted to make sure that the

six men and six women from Northern Virginia are focused more on the

evidence than on the sometimes salty comments he made to the Muller team

about their approach their witnesses and their evidence so the judge told the

jury since you're the sole and exclusive judges of the facts in this case you

should not construe any comments the court may have made

on any question or any questions to court may have asked witnesses as

expressing an opinion on the evidence the Muller team conceded in their

closing argument that their star witness palm Ana ports former business partner

Rick Gates might have some credibility problems prosecutor Greg Andres told

jurors they don't need to trust every word Gates said but they should put it

into context with the rest of the evidence and Andres run the Millar team

stressed that quote ladies and gentlemen the star witness is in this case is the

documents the man afford defense team meanwhile thinks they have wedged enough

doubt into the Muller team's case that jurors can't convict Richard Wessling

was looking around the room as it turns out there's a prosecutor named mr. Trump

who was there for the next case back to you in New York

well fine as the jury deliberates what does a conviction mean for the

president nothing look at the charges they're bank fraud their failure to pay

your taxes failure register with the government properly I think if he's

found a violation that's you know something that he's clearly done wrong

and the justice is being served but has nothing to do with the president at all

I mean there's in fact judge Ellis has made it very clear that any allusion to

the president is out of bounds because none of the charges have anything to do

with them and I think that it kind of gets back to that to the underlying

point here which is that clearly he's get it going after all of these outside

of the area charges against manna for because he wants him to flip or to give

information exchange for some kind of conviction

sentencing to get the bigger fish in this case what he believes is the

president Wow so Maria Alice key the flipside that if man affords acquitted

what does that mean for the Mahler investigation well I'm not sure we can

draw a lot of you know lessons for the broader Muller investigation but is it a

blow to his ability to to bring charges I don't think so he's already brought

dozens of charges against both Americans and Russians on a whole host of issues

and we do know that people like Mike Flynn are cooperating and so we'll see

what else Rick Gates gave them as well he's cooperating probably just beyond

metaphor I think that Paul manna fors team really took an interesting tactic

to not bring any witnesses of their own they did not get a plea agreement mana

force seems to think he can beat this but he is facing hundreds of years in

jail time if he's convicted and I will say to Sean you know the president says

he hires the best people we've all known Nana for played a little fast and loose

and he brought him to run the campaign and well this isn't a surprising outcome

for a lot of people who've known Paul mana for I think look I wrote all about

this in my book that that man afford at the time we were heading into a

convention in Cleveland where there was this never Trump effort afoot to put a

new candidate on the ballot to release the delegates all this stuff man afford

going back to the Ford administration had done convert the last brokered

convention he is but he was brought in for a specific reason on a very specific

task to be a delegate counter at the convention at what could be potentially

an effort to undo the Doggett's to change the rules he had done dole Ford

Reagan I mean this is a guy who you can claim all these other business issues

about him or tax issues but when it came to understanding the delegate math and

brokered convention system this was the right guy Sean you know I've been asking

this question why didn't the FBI give the campaign a heads up if they were

looking at Paul Manafort you know they gave Hillary Clinton a heads up when

looking at things with with what was going on behind the scenes with her but

they didn't do the same Lindsey Graham Senator Lindsey Graham is saying and

he's writing a letter to Christopher ray this week the the current FBI director

why was there a difference I don't know I mean have helped I think

that I'm not familiar with what standard FBI procedure is in a criminal

investigation or I mean at that point maybe they didn't know I have a theory

got a correlation in just a theory but before the convention we weren't hearing

a lot about Russian pollution or Russian influence so if you look at the charges

Paul Manafort is up against today with the jury they have nothing to do with

being influenced by Russians from a political perspective or from being used

for espionage resources he's up against charges that have him operating on a

business level and not reporting taxes and being corrupt in that fashion so

maybe the FBI saw it as irrelevant to the campaign because it actually had

nothing to do with the campaign and everything to do and it doesn't which is

why the judge wouldn't let it enter it into the courtroom yeah let it be

entered into the courtroom it's it's an interesting kind of look at how things

were going on back then because you're talking about Paul man affords you know

resume coming in and he would be a guy that you would want right necessarily

for brutal convention he also had a history of representing dictators around

the world and yes he did a good job counting delegates but at some point

campaigns have to make decisions about who works for them again with all due

respect there are a number of people what about and so the the the thing

that's so fascinating Katie talks about this and mentioned this but back then

there was this idea that we weren't colluding with ourselves suddenly we win

and it's like that everyone wants to investigate every single person and

manufacture this whole idea of collusion up but at the time it was Hillary

Clinton that had taken money from the Russians Bill Clinton who had done deals

with with under rhenium so I mean if we're gonna bring up people I think one

of the things is missing in all of the context of this Russian investigation is

we still haven't figured out the other side of this what was going on with the

Clintons what was going on with the DLC well okay but up for every single thing

that's leaked out about this not once have we heard about somebody from the

Democratic side except for or I'm actually not sure of anybody actually

being investigated a question Tony Podesta leaving and we've got to get

going although I feel like this conversation could keep going for a

while okay go all right well a newspaper and

House Minority Leader Nancy Pelosi is home state saying it's time for her to

give up her quest to become Speaker of the House again the paper calling it a

distraction and damaging to her party whether Pelosi will listen or not

plus the potential showdown between the president and robert muller

the big line in the sand now being drawn by one of the president's lead lawyers

and how this may end up before the Supreme Court stay tuned for all

well new developments and a potential showdown between the president and

robert muller special counsel Rudy Giuliani reportedly saying the

president's legal team is preparing to fight a potential subpoena from Muller

the former mayor and federal prosecutor telling the Washington Post quote we

would move to squash the subpoena and we're pretty much finished with our

memorandum opposing a subpoena Giuliani adding that trumps attorneys

are ready to argue it before the Supreme Court if it ever got there and Giuliana

reportedly expects veteran Washington lawyer Emmett flood to play a big role

in a legal flight flood joined the Trump legal team in May and he also served as

Bill Clinton's impeachment lawyer flood has reportedly cautioned the president

that a subpoena fight could be decided by the nation's highest court and that

would be unprecedented during the Clinton administration independent

counsel Kenneth Starr served President Bill Clinton with a subpoena but it was

withdrawn after Clinton agreed to testify so Sean Spicer where are we with

the subpoena fight yeah with all my I'm going to do an interview it's not gonna

do an interview and when is it gonna happen it's not gonna happen I'm not a

lawyer just to be clear but I think this is the posturing that you do ahead of

time you want to make it very clear what you will do what you won't do and you

lay that lay that groundwork out there so that's that's clearly with what Rudy

Giuliani is doing on behalf of the president's legal case is making sure

that he's publicly communicating to Muller we're willing to do this if

you're willing to give us this but all of this normally happens behind the

scenes I think there's a reason that publicly they're doing it the way they

are which is to make sure that people understand that they are willing to do

it but there are terms to do that and that it is being done in a way that

protects the president as any client would want you would never allow a

client to walk into something and just let it free you know free for all so I

think part of this is to make sure that people who even on both sides understand

why he's doing what he's doing or why he's not

so Lisa based on your background in public relations and communications is

can you pick up on what Sean said about this idea that the Trump team whether

it's his personal lawyers or the White House Counsel has been out front they've

actually been pretty successful about turning public opinion against the

Moller probe oh yeah and I think that was sort of the frustration yeah we've

seen it in polling of you know the tides shifting a little bit there and I do

think that depending on what happens with the mana for a case that could also

pack that as well if they're unsuccessful in bringing charges against

mana four people might sit back and say this is a big waste of time there I

think there's an increasing frustration with the time and the length of this

going on and the impact it's had on the president an ability for him to do his

job but I think the president the reason why there were changes in the legal team

is I think he was getting so sick and tired of the PR battle and feeling like

they weren't out there fighting it enough and all this really could be is

Giuliani and his team trying to get you know made more favorable concessions

with President Trump potentially sitting down we don't really know what the true

meaning is behind it so I will say that Murray brought up a moment ago how

man-of-war taking a big or his team is taking a big legal risk and I agree with

that I mean that by sort of resting your case without showing any witnesses

you're willing to to put a that's a pretty big game another one that being

said if he wins if mana forts successful I think from a purely PR and political

standpoint that's a huge blow to Muller I don't think it has anything to do with

the president either way but I think from a from a public standpoint you say

you went after this guy guns a-blazing you threw everything at the kitchen sink

Adam everyone flipped on them and you got nothing if mana fort is successful

by getting off of these charges I think that is publicly a big blow to to Muller

and his team because I think people starting Muller cares about the pide

relations I think he's like head head down doing the legal work and a subpoena

fight legally I don't know how that would turn out in the courts I don't

know how you can ignore it though yeah we have to go we got to move on thanks

guys or words now between New York Governor Andrew Cuomo and president

Trump after the top Democrats stunned an audience yesterday when he unleashed on

president Trump's make America great again slogan reaction from the couch
