so the Obama administration they're spying scandal continues to grow now
yesterday cheryl atkinson wrote an op-ed in the hill was entitled it looks like
obama did spy on trump just as he apparently did me now as we told you
earlier in the program sources telling Fox News the former UN Ambassador
Samantha power was unmasking Americans almost one a day joining us now with the
reaction is the author of the smear the host of full measure cheryl atkinson and
from the american center for law and justice and president Trump's attorney
Jay Sekulow Cheryl I just want to hand it to you because you're right it did
happen this unmasking at a level we never even imagined before I want people
to hear your story because this is so important well mine began before we
heard about what the government had done to Associated Press and Fox News before
Edward Snowden I had Intel sources come to me and suggest that I was likely
being monitored by the Intel community or by certain actors and the Obama
administration because of the stories I was doing long story short some people
in the Intel community helped me because they thought this was so egregious had
forensics done on my computers multiple computers from CBS and my personal
computers and three independent exams have seen and proven forensics that they
used government proprietary software to monitor my keystrokes planted
confidential classified documents in my computer watch much about well what I
was doing exfiltrated files listened in on my audio we have dates times and
methods for a lot of this as well as government-owned IP addresses found in
my computer Jay Circulo this is not the country that I know with Fourth
Amendment protections against unreasonable search and seizure now
though that that sounds to me like the weaponizing of the tools of intelligence
to attack people they don't like or political opponents well we know that
was in fact what happened so let's be clear about a couple things that would

that you would utilize the intelligence community to
I own your enemies domestically in which again it is not only outrageous but it's
illegal couple that with the fact and we now know this the unmasking that was
going on and by the way the UN Ambassador Samantha Power's unmasking
basically almost a person today and especially picked up towards the end of
the their political run if you will at the end of their term now President
Obama's term ask yourself this question why did they decide at that point to
quickly start unmasking and that means by the way we're talking about American
citizens as well that are being unmasked by the UN Ambassador and she served
within the National Security Council well that's great but the fact is this
unmasking which was supposed to have not take place often we're supposed to
utilize minimum or minimization techniques apparently these were
advisory rules for the previous administration rather than the actual
rules and laws that apply and I think the the tragedy in all of this is the
American people are the ones that pay the consequence so if Samantha power
Susan Rice Ben Rhodes and again in the case of Samantha power I'm asking a
person a day when is that when did that become the role of the UN ambassador
that's beyond bizarre and that's unprecedented and that raises questions
this was all political but here's my question with all the the non-stop
chatter in the media about Russia Russia Russia Russia it's clear they've now got
a big target on Paul Manafort for example but then you've got all those
people unmasking surveillance intelligence leaking a crime you got all
the Hillary Clinton's felonies we've been over there's many many times and
you got a leak a day then you got Muller and and Rosenstein and call me where is
the Congress where is the special counsel what is the Attorney General
doing here and doesn't it shouldn t be playing a big role in investigating what
seems to be real crimes and maybe constitutional violations like in the
case of Cheryl well look I think that first of all we they may be doing that I
mean what Sean I mean if it was done properly if there's an investigation
going on we would not know that so I would I
would hope that the whole aspect of the leaking scandal that is taking place now
for months and months and months including conversations that the
President had with foreign leaders I mean this is not something that should
be tolerated in any administration no matter what your political leaning is I
mean this is just the out and frankly illegal again an outrageous but we know
that it was taking place so what we're hopeful is that there is
actually an investigation going on now you don't know this for a fact it's
speculation on my part I don't have any independent knowledge of it but you
necessarily would not so you know would not necessarily know that there was so
you can be hopeful that there is in fact an ongoing investigation and that this
you know aspect of leaking national security matters will stop Cheryl I I've
had good people in the intelligence community that told me I was unmasked
I've never been able to corroborate that I have no idea if that's ever happened
I'm watching what happened to you and you can give dates and times what
recourse as a citizen with constitutional rights you have because
you can prove your case not much I mean the only reason I can prove it is
because I had helped from people inside the Obama Intel community that thought
this was so egregious they gave me the tools that I wouldn't normally have had
to find this information forensically I have a two-and-a-half-year-old lawsuit
there's a hearing tomorrow in fact against the Department of Justice which
the current Department of Justice continues to fight rather than directing
them to tell the truth follow the law and get at the facts they're continuing
to fight this in federal court that's the only recourse so most people can't
do that it's very expensive and time-consuming it's very hard to sue the
government you have to go through a lot of processes get permission it's it's
almost insurmountable alright we will continue our investigation but cNN has
learned that investigators wiretapped former Trump campaign chairman Paul
Manafort under secret court order both before and after the 2016 election and
that surveillance continued into this year including a period when Manta fort
wasn't working for the campaign but was known to talk with President Donald
Trump Pamela brown Evan president shamone propels broke this story and
they are out front tonight so much to ask all of you as this break so Evan
let's just start off with the bottom line here what are you learning
tonight well Aaron sources tell us that the FBI got permission from the
secretive Surveillance Court to monitor Paul Manafort the former Trump campaign
chairman before and after the election now this is an extraordinary step for
the FBI to do surveillance on a high-ranking campaign official and of
course Manafort is now at the center of the Russia meddling investigation we're
told that there are intercepted communications that raised concerns
about whether Manafort was encouraging the Russians to help with the campaign
now other sources told us that this intelligence was not conclusive enough
Robert Special Counsel Robert Muller's team has been provided all of these
communications they're so evident when you say encouraging Manafort encouraging
Russians to help with the campaign obviously the weight of everything is on
that word encouraging what do you mean by it right there's there's a lot we
don't know about exactly what was said am i worried this is beyond just wiretap
it's also surveillance of all kinds including searches that that the FBI is
authorized to do but we're told that the FBI has communications between suspected
Russian operatives relaying what they claimed were discussions with Manafort
as well as communications involving Manafort none of this has amounted to
what people consider a smoking gun in this investigation there's still more
work being done to determine whether there's a criminal violation here we
didn't get a comment from Paul Manafort spokesman but Manafort has previously
denied that he ever knowingly communicated with Russian intelligence
operatives during the election he's also denied helping Russia undermine the US
interests Aaron so Pamela you're reporting here that
Paul Manafort has been monitored not once but twice that's right Aaron so our
team is told that the secret order began after manna four became the subject of
an FBI investigation in 2014 we previously reported that centered on
work done by a group of Washington consulting firms for Ukraine's former
ruling party our sources say and the surveillance was discontinued at some
point last year for lack of evidence according to one of the sources and then
the FBI restarted the surveillance after obtaining a new FISA warrant that
extended at least into early this year the sources say the second warrant was
part of the FBI's efforts to investigate ties between Trump
campaign associates and suspected Russian operatives now it is unclear
when that new warrant started and as part of the the FISA warrant we've
learned Aaron that earlier this year the FBI conducted a search of the storage
facility belonging to Paul Manafort and as you'll recall this past July under
Robert Muller's direction the FBI raided his home in Virginia and of course we
knew that but as part of what you're breaking tonight that that rate of the
storage facility obviously new information we know he had a storage
facility until this hour and we didn't know that they had raided it so that's
also very significant shamone do you know though whether President Trump
spoke to manna fort while he was under surveillance that of course could be
crucial here as well yeah exactly our an extremely crucial but what we do know
and what we've been told by sources is that the president and Manafort were
still talking earlier this year well after the campaign and it is a time that
we've learned the FBI was listening to manna firts phone calls so it is
possible that those phone conversations were collected during that surveillance
as they were listening to them so that we don't have a specific answer for but
it is possible Aaron all right which is a crucial point and of course the
President had said vocally again and again that he was wiretapped and that he
meant that to mean not just phones but all kinds of surveillance was he right
well not exactly so we do know that you know and the Justice Department has
spoken out about this and they have denied that the president's own lines
were tapped were wiretap but as we said it is possible that he was picked up on
Manafort surveillance we should know that madam furred does have a residence
in Trump Tower but it is not clear if the FBI did surveillance on madam Ford
at Trump Tower so so Pam what does this mean all of this for the Moller
investigation as you and Evan point out he now is in possession of whatever came
from this this this wiretap right he is in possession it is in his hands and the
palm man afford investigation has been really the most visible investigation
under Robert Muller the Special Counsel started in May and and there we know
that there is a raid on his storage facility before Robert Miller took
but then you have that raid this past July it's unclear if those stemmed from
any of the intelligence that was gathered under the FISA warrant but it
is clear that investigators are still very interested in de Paul Manafort
under the direction of Robert Muller Aaron and having a couple questions here
a one obviously manna fort for some time with all of this focus I'm sure has been
careful in what he says and how he communicates but but do you know if this
surveillance is still ongoing in any way and what is the significance that they
were able to get this crucial FISA warrant to do it well we don't know
exactly when the the timeline of this surveillance whether it has ended
whether it is continuing to this day but look the fact that they were able to get
a FISA warrant is a big deal the fact is that this has to get approval from the
highest levels of the Justice Department and the FBI before agents can carry out
this type of surveillance it's considered so intrusive that you almost
never find out that these FISA warrants are authorized Aaron and then the other
thing is that you have to present proof or suspicions that someone is acting as
an agent of a foreign power all of this goes into providing the paperwork that
these judges then have to approve before allowing the FBI to do this type of
surveillance it's very intrusive work very interested working obviously very
not easy to get really hard to get as you all point out all right thank you so

there is an awful lot going on just minutes ago the White House
released a letter saying the president is inclined to declassify that
Democratic Committee memo and will work with the House Intelligence Committee to
see if they can come up with a releasable version of it much redacted
but that is not the only breaking news tonight there's a lot more the Russia
story has suddenly become an FBI story and it's moving faster than anyone
anticipated just a year ago all the smart people were mocking Donald Trump
for being insane enough to suggest the Obama administration had surveilled as
he put it wiretapped his campaign what a paranoid lunatic they said get off
Twitter yeah now we know what actually happened the question at this point is
how many people in Trump's orbit weren't spied on by the FBI
Trump advisor Carter page was placed under government surveillance in
the fall of 2016 after the feds used uncorroborated claims from the Trump
dossier to justify a FISA warrant we know from congressional testimony that
Paige spoke with Trump advisor Trump campaign manager Steve Bannon while he
was being spied on meaning that Bannon was likely spied on
to tonight based on her own reporting we can tell you that Carter page also sent
email messages to members of the Trump campaign during that same period
presumably the FBI intercepted those as well so it looks like the Obama
administration may have spied on a significant portion of the Trump
campaign team just how many people were surveilled and to what extent how much
did President Obama know about it we still don't have the answers to those
questions though we definitely have the right to them oh no we don't say
Democrats asking questions is a sign of disloyalty to this country the very
people who once told us that spying absolutely never happened are now
telling us the spine was perfectly justified and normal why because Russia
okay but the funny thing is almost all of the Russian collusion evidence
unearthed recently implicates Democrats not the Trump campaign yesterday we
learned that for example Senator Mark Warner of Virginia was secretly sending
text messages to a lobbyist for a Russian oligarch in the hope of making
contact with the dossier author Christopher Steele Werner tried to hide
that correspondence I'd quote rather not have a paper trail he texted to the
oligarchs lobbyists now traditionally in Washington anyway
no paper trail is not an indicator of transparency in fact it's a sign of
wrongdoing now we're not saying that Senator Warner ought to resign his seat
and face treason charges and we're not saying that because we're not hysterical
liberals willing to poison our international relations and misuse the
justice system just for Pleet cheap political ends but we do think that
Warner's behavior is worth knowing more about and so by the way is a remarkable
new New York Times story just published about 40 minutes ago that story alleges
that within the last year American intelligence agencies paid a spy
apparently a spy working for the Russian gun
and $100,000 in American tax dollars in exchange for unverified and possibly
fabricated information about President Trump now why would our intelligence
agencies use our money to do something like that why would they do anything
like that under any circumstances and by the way what was the information they
gathered used for none of that is clear at this hour here's what is clear right
now the bottom line and what we've learned this whole week the one thing
worth taking away from a dramatic week in Washington is this the Obama
administration spied on a rival political campaign there had better be a
legitimate reason for doing that but increasingly it looks like there wasn't
Fox chief national correspondent and Henry joins us with more on that
Russia Intel story yet well Tucker this is just breaking this hour the New York
Times reporting that a shadowy Russian tricked American spies actually out of a
hundred grand last year they promised not just information on Donald Trump but
to deliver stolen national security agency cyber weapons in a deal that this
shadowy Russian and system would also include yes compromising material on the
president sounds like a spy novel the NSA has been devastated by losing these
secret hacking tools so they delivered the cash in a suitcase
to a Berlin hotel room in September supposed to be the first installment of
a million dollar payout here's the kicker the Russian claimed the
information would link the president and his associates to Russia but instead of
providing the hacking tools Russian produced unverified and possibly
fabricated information involving mr. Trump and others bank records emails
purported Russian intelligence seta sounds a little bit like the steal
dossier several us in telefilms tell us tonight they made clear they did not

want the Trump material from the Russian they're insisting they never wanted this
he was suspected of having murky ties to Russian Intel into Eastern European
cyber criminals that's what they tell the New York Times but it sounds like in
US Intel officials are kind of spinning after the fact because they were in
negotiations the NSA even used its official Twitter account nearly a dozen
times to send out coded messages to this Russian the Russians eagerness to sell
the Trump direct raise suspicions among American spies because it was part of an
operation to feed the information out into the United States intelligence
community and pit us intel officials against mr.
Trump it was confusing because at one point this Russia dropped his asking
price from about 10 million dollars to just over a million dollars that raised
alarm bells then he showed a 15 second clip of a video showing a man in a room
talking to two women he claimed it was mr. Trump but there was really no way to
confirm that it was mr. Trump with two women it was a grainy video it had no
audio and we're told that these officials were shown the video in the
Russian embassy in Berlin so this does sound like a spy novel and as you were
just saying the president some time ago was suggesting that the some US Intel
officials were out to get him people said this is crazy that wouldn't happen
but now The Times is reporting tonight a remarkable story suggesting that they
were willing to pay a million dollars to potentially get dirt on the president US
intelligence officials they gave us out a hundred thousand dollars the first
installment and the shadowy Russian took the money went away without any dirt on
the president the transition team is essentially accusing Special Counsel
Robert Moeller's office of bad behavior and how it obtained these emails and
suggesting investigators may have violated the Fourth Amendment by
collecting that information without a warrant now in a letter to top lawmakers
the transition team claims in August the special counsel's office requested tens
of thousands of emails along with laptops cell phones and other materials
belonging to 13 top transition team members that request was made to the
General Services Administration that's the government agency that provides
office space supplies and email services to presidential transitions now at issue
is who that material and data belongs to the GSA claims it's government property
and it should be accessible to law enforcement officials but the transition
claims it belongs to them that it shouldn't have been handed over without
their consent and that much of it is predicted by presidential and
attorney-client privilege in their letter states in short since the GSA
improperly provided them to the special counsel's office the PTT which is the
presidential transition team's privileged materials have not only been
reviewed privately by the special counsels office without notification to
TFA they have also been missed used publicly now the special counsels office
is pushing back and in a statement to BuzzFeed news said when we have obtained
emails in the course of our ongoing criminal investigation we have secured
either the account owners consent or appropriate criminal process and today
on the sunday shows a number of Democratic lawmakers said despite these
new revelations or accusations rather they continue to have full confidence in
Special Counsel Robert Moeller I do not at all believe that that Mister Mahler's
has been compromised or his investigation
I think he's beyond reproach now President Trump is spending the weekend
at Camp David meeting with members of his cabinet and doing some phone calls
with world leaders including Russian President Vladimir Putin he spoke to him
earlier today and we're waiting to hear more details from the White House about
