A U.S. appeals court ruled Thursday that President Donald Trump cannot immediately end an Obama-era program shielding young immigrants from deportation

A three-judge panel of the 9th U.S. Circuit Court of Appeals kept in place a preliminary injunction blocking Trump's decision to phase out the Deferred Action for Childhood Arrivals program

Lawsuits by California and others challenging the administration's decision will continue in federal court while the injunction remains in place

DACA has protected some 700,000 people who were brought to the U.S. illegally as children or came with families that overstayed visas

The Trump administration has said it moved to end the program last year because Texas and other states threatened to sue, raising the prospect of a chaotic end to DACA

The decision prompted lawsuits across the nation, including one by California. A judge overseeing that lawsuit and four others ruled against the administration and reinstated the program in January

U.S. District Judge William Alsup rejected the argument that then-President Barack Obama had exceeded his power in creating DACA and said the Trump administration failed to consider the disruption that ending the program would cause

The Trump administration then asked the 9th Circuit to throw out Alsup's ruling.During a hearing in May, Deputy Assistant Attorney General Hashim Mooppan argued that the courts could not review the administration's decision to end DACA and defended the move against assertions that it was arbitrary and capricious

'It's a question of an agency saying, 'We're not going to have a policy that might well be illegal,'' Mooppan told the judges

The judges on the 9th Circuit panel appeared skeptical of the argument that the DACA decision was beyond the court's authority to review

Judge Jacqueline Nguyen questioned whether courts could intervene if they thought DACA was legal and disagreed with the administration's position that it wasn't

The administration has been critical of the 9th Circuit and took the unusual step of trying to sidestep it and have the California DACA cases heard directly by the U

Democrats Want Barron Deported, Trump & His Supporters Deliver Response - Duration: 5:17.

Hours before the results of Tuesday's midterm elections were announced, the Democrats attempted

one last ploy to win votes by asserting that Barron Trump ought to be deported.

It wasn't long before they were in for a nasty surprise, though, courtesy of President

Donald Trump and his supporters.

During an interview with Axios published last Tuesday, President Donald Trump discussed

the prospect of ending birthright citizenship, which allows millions of immigrants to come

to America illegally and have babies here who automatically become U.S. citizens simply

because they were born on our soil.

This inspired a fierce debate over the 14th Amendment, which says, "All persons born

or naturalized in the United States, and subject to the jurisdiction thereof, are citizens

of the United States and of the State wherein they reside."

Conservatives have argued that the 14th Amendment was only intended to provide citizenship to

children born in the U.S. to lawful permanent residents — not to unauthorized immigrants

or those on temporary visas.

John Eastman, a constitutional scholar and director of Chapman University's Center

for Constitutional Jurisprudence, believes the Constitution has been misapplied over

the past 40 or so years.

He says the line "subject to the jurisdiction thereof" refers to people with full, political

allegiance to the U.S. — such as green card holders and citizens.

However, those leftists who say ending birthright citizenship would be akin to changing the

Constitution have never had an issue with re-writing the Second Amendment.

"On immigration, some legal scholars believe you can get rid of birthright citizenship

without changing the Constitution," Axios reporter Jonathan Swan asserted in his interview

with Trump.

"It was always told to me that you needed a constitutional amendment.

Guess what?

You don't," Trump responded.

"You can definitely do it with an Act of Congress.

But, now, they're saying I can do it just with an executive order," he continued.

"We're the only country in the world where a person comes in, has a baby, and the baby

is essentially a citizen of the United States for 85 years with all of those benefits.

It's ridiculous.

It's ridiculous, and it has to end," the president added.

Of course, the mere discussion of ending birthright citizenship was enough to send liberals through

the proverbial roof.

"President Trump's new claim he can unilaterally end the Constitution's guarantee of citizenship

shows Republicans' spiraling desperation to distract from their assault on Medicare,

Medicaid, and people with pre-existing conditions," Rep. Nancy Pelosi (D-CA) said in a statement.

"The President does not have the power to erase parts of the Constitution, but he and

the GOP Congress have spent two years trying to erase protections for people with pre-existing

conditions," she added.

"Clearly, Republicans will do absolutely anything to divert attention away from their

votes to take away Americans' health care."

Leader Pelosi's statement condemning Trump's wish to end birthright citizenship quickly

pivots to healthcare, which has become Democrats final argument heading into Election Day.

Obviously, President Donald Trump is and always has been a U.S. citizen.

None of his children are anchor babies.

There is a big difference between a legal immigrant and an illegal immigrant.

If the Democrats thought they could drum up more support in the midterms by obsessing

over this issue, however, they were sorely mistaken.

Tuesday's election was a major win for President Donald Trump and his supporters.

With the GOP firmly in control of the Senate, Democrats have no choice but to work with

their Republican counterparts if they want to get anything done.

And, they're going to have to get something done if they want to keep their seats in the

next election.

It is truly a nightmare scenario for those on the political left.

In a stunning turn of events, President Donald Trump abruptly demanded Attorney General Jeff

Sessions resign the morning after the midterm elections, finally making his move against

the man who ultimately failed to fulfill what the President saw as his purpose — protecting

Trump and his team from the consequences of their meddling in the 2016 election and their

alleged collusion with agents of the Russian Federation.

The firing of Sessions paves the way for Trump to appoint a new Attorney General willing

to lick his boots and obey his orders — like Sen. Lindsey Graham (R-SC), for instance — which

would then open the door for the firing of Special Counsel Robert Mueller and the suppression

of the results of his two-year-long investigation into the Donald Trump campaign and administration.

The president has long resented Jeff Sessions for recusing himself from the Trump-Russia

investigation in March 2017 after evidence of his secret meetings with Russian Ambassador

Sergey Kislayak became public knowledge.

"I put in an attorney general who never took control of the Justice Department.

Jeff Sessions, never took control of the Justice Department.

It's sort of an incredible thing," complained Trump in an interview with FOX and Friends'

Ainsley Earhardt.

"Jeff Sessions recused himself, which he shouldn't have done or he should have told

me.

Even my enemies say that Jeff Sessions should have told you that he was going to recuse

himself and then you wouldn't have put him in.

He took my job, and then he said, 'I'm going to recuse myself.'

I said, 'What kind of man is this?'"

Sessions, a notorious white supremacist, knew that his failure to recuse himself would interfere

with his real goal — to use the Justice Department to escalate the "War on Drugs"

and impose his racist agenda on an unwilling populace.

Seeing as Mueller was rumored to be presenting the results of his investigation to the Justice

Department as soon as this afternoon, it's no surprise that Trump is wasting no time

before making his move.

His appalling behavior at this morning's press conference, the reports that the President's

son is likely facing indictment, and the speed at which he's moving indicates that Trump

is terrified about what Mueller is about to do — and makes him appear all the more guilty.

CNN released a statement attacking President Donald Trump for his spat with CNN's White

House correspondent Jim Acosta on Wednesday afternoon.

"This President's ongoing attacks on the press have gone too far.

They are not only dangerous, they are disturbingly un-American," CNN's statement reads.

"While President Trump has made it clear he does not respect a free press, he has a

sworn obligation to protect it.

A free press is vital to democracy, and we stand behind Jim Acosta and his fellow journalists

everywhere."

CNN's message was in response to a heated back-and-forth between Acosta and Trump during

the president's press conference in which Acosta began by trying to challenge the president

on a statement he made about immigration prior to the midterm elections.

Acosta proceeded to bring up the president's rhetoric about the migrant caravan that's

headed from Central America through Mexico to the southern border of the U.S.

When Trump fired back, Acosta turned to an ad released by the president that many news

outlets have refused to show for its depiction of illegal immigrants.

"I tell you what, CNN should be ashamed of itself having you working for them.

You are a rude, terrible person," Trump responded at one point.

"You shouldn't be working for CNN.

You are a very rude person.

The way that you treat Sarah Huckabee is horrible.

And the way that you treat other people are horrible.

You shouldn't treat people that way."

"I will pay the price for it, but as long as we're able to speak our minds, I think

I should have the right to be wrong in your opinion."

And while he also said that "any entertainer shouldn't get into politics because half

of the audience is going to hate you," he broke his own rule — and his most Instagram

was subsequently filled with hate comments about Trump.

If so time to unfollow."

"One thing is being republican but another thing is being a trump supporter, I truly

hope you're not a trump supporter or you lost a fan."

Although Rodriguez is a Trump supporter, he said his vote in 2020 isn't set.

Trump Backs Pelosi For House Speaker, Sets Clever Trap For Democrats - Duration: 4:10.

The Democrats regained control of the US House of Representatives on Tuesday, which seems

like a set back for President Donald Trump's agenda, but he's a "glass half full"

kind of guy and knows an opportunity when he sees it.

He's now backing Nancy Pelosi for House Speaker, setting a trap for Democrats.

The presumption is that California Democrat Nancy Pelosi will assume the role of House

Speaker, a position she held briefly in the Obama-era, but there is a sizable faction

from her party that wants someone more competent for the job.

Trump knows that with lunatic Pelosi at the helm, it can only mean good things for him

and the GOP in 2020, and he is lobbying hard to get her the gavel.

Before the vote tallies were in, former Vice President Joe Biden told NBC News that he

was certain Trump would question the results of the midterm elections if the Democrats

took control of the House.

"I guarantee he'll challenge the legitimacy of the vote.

You know he's still looking for that million crowd that was there for his inauguration,"

said Biden of Trump.

Of course, Biden was wrong because he's wrong about nearly everything, and Trump actually

called up Pelosi to congratulate her and the Democrats for their win, according to Fox

News.

This was a little out of character for Trump, who has been locked in a war of words and

insults with Pelosi since he took office, but maybe the President isn't quite the

jerk the liberal media tells us he is.

On top of that congratulatory phone call, Trump took to Twitter to actively lobby the

Democrats to give Pelosi another shot at House Speaker.

In all fairness, Nancy Pelosi deserves to be chosen Speaker of the House by the Democrats.

If they give her a hard time, perhaps we will add some Republican votes.

She has earned this great honor!

See, isn't that nice? Trump not only says Pelosi has earned the right to be House Speaker,

but that he and the Republicans will do what they can to help her get the gig.

All of this warm and fuzzy Trump stuff came after Pelosi announced that under her reign

of fussiness the House would do nothing but obstruct the President's agenda and waste

taxpayer money on endless investigations against him.

Okay, something doesn't seem quite right, does it?

Why would Trump be so keen on seeing Pelosi, who qualifies as an archenemy, get her bony

hands on the Speaker's gavel again?

If anything, you'd expect Trump to give her a nasty nickname like Nancy "Pel-Loser"

while attacking her slurred speech and glaring hypocrisy.

It's because Trump knows that Pelosi is campaign gold for Republicans.

She is so loathed in most parts of this country that having her in charge means Republicans

— and Trump himself — can use her objectionableness to their advantage in 2020.

Pelosi's literally a scarecrow that terrifies voters everywhere except in liberal California.

The Golden State is already going to the Democrats in the presidential election, but most of

the rest of the country is wide open.

A Nancy Pelosi speakership is a ready-made campaign ad against whacko liberalism and

bad governance.

Plus, as a bonus, Pelosi is both crazy and incompetent.

With her at the helm, the Democratic-controlled House will do nothing but run in circles.

Under her leadership, Trump's agenda isn't threatened as it might be by anyone who isn't

a senile lunatic.

It's not certain that the Democrats have anyone who isn't a bungling kook, but with

Pelosi, Trump knows his plans are safe.

It's not unusual for the party of the sitting president to lose control of the House.

It happened to Bill Clinton and Barack Obama.

While those two saw a crisis, Donald Trump sees an opportunity.

With Pelosi embarrassing the Democrats, Trump can cruise to reelection and the House will

flip back to the GOP in two short years.

has been elected to a third term.

Navy officials confirmed this week that 14 sailors

during a hour and a half press conference.

-Well, he was asked... -Yes.

-...about him very specifically. -And yet chose --

But there's obviously something he knew was happening.

What is your take on this? -Yeah.

-What are you hearing from your sources

as far as was this a forced resignation?

-100%, the President asked Jeff Sessions to resign.

Jeff Sessions handed him that resignation letter,

which said, "You asked me to resign.

Here is my resignation letter." [ Laughter ]

This is not surprising. This was expected.

This has been rumored, if you guys follow the news,

rumored for months and months.

That doesn't mean it's not still significant, right?

This is a really sort of critical moment here.

Because if you look at the arc of where Republicans were,

for example, back last year, remember when Lindsey Graham,

the Senator, said, "There will be holy hell to pay

if Donald Trump fires Jeff Sessions."

Lindsey Graham has certainly changed his tune

as Republicans have come to accept, I think,

kind of reluctantly that relationship is just broken.

It's broken beyond repair.

So, what I'm hearing, what we're hearing

from our team at NBC News, is that Jeff Sessions

may not be gone from the political world.

He's considering possibly, per people close to him,

running for his old Senate seat back in Alabama.

-That Doug Jones seat. Right.

-Going up against Doug Jones.

So he may end up back in Washington,

perhaps working with or against President Trump again.

-I don't think he'll ever work against President Trump.

That is my takeaway.

I feel as though most of the Republicans who've shown

any resistance to him ultimately are never going to

truly resist anything Donald Trump tries to do.

-The interesting thing about Jeff Sessions is,

there's a lot of headlines --

Listen, this all matters as it relates --

A lot of it matters as it relates

to the Special Counsel investigation, right?

Which Jeff Sessions recused himself from.

That was, in the eyes of the President, the original sin,

the thing he could never forgive Jeff Sessions for.

But here's the thing -- if you look at the DOJ,

they've actually implemented almost more

than any other agency, Donald Trump's agenda.

-Yeah. -Jeff Sessions has done exactly

what Donald Trump has wanted him to do.

So there's this really interesting, I think,

split or dichotomy between the political sphere,

the political side of it, and then the policy side.

-I want to ask about the fact that Donald Trump --

You know, the Russia investigation

is the reason he fires Jeff Sessions.

Obviously, that's a little bit more stressful for him now

that the Democrats have taken back the House

and they have this power of oversight.

Do you think --

Obviously, based on the press conference today,

it struck me that was a man who was a little stressed out.

Is it likely that that's what stressing him out?

-Part of it, yeah. -Yeah.

-Listen, for the first time, he's now in Washington,

he's inside the White House,

and he is facing a check on his power.

That has not happened for him before.

So, I think he's in this mode where he's looking around,

and that's what we're hearing from folks is --

[ Cheers and applause ]

And he's seeing, "Hey, now Democrats do control

the House of Representatives."

There will be an onslaught of subpoenas,

and that's a hassle for West Wing staffers.

You have to deal with that.

It's paperwork, it's time, it's energy,

and it's also something that Donald Trump knows

is going to be coming.

Now, what he did today was issue, essentially,

a threat to the Democrats.

Like, "Hey, I'll work with you on infrastructure,

I'll work with you on trade, but not if you come at me

about my tax returns," for example.

Nancy Pelosi didn't seem so keen on that when she spoke, so...

-Well the thing I would say why he wouldn't be keen on it,

and this is just based on everything

he's ever said or done, I don't believe

that he's actually gonna be honest on that deal.

Right? Do actually see --

Do you think if Democrats laid off tax returns

he would actually make a deal on infrastructure?

-So, here's what I can say.

This is a president and this is a person --

and I've covered Donald Trump for his campaign, his candidacy,

the transition, the presidency now.

He is somebody who has issued threats

and not always followed through with them,

and that's just the facts of the case.

So there's not a lot of past history to point to

that the President would necessarily follow through

on the threat that's he's making today.

-You've been in a lot of press conferences.

Were you watching today at that mayhem,

and was part of you jealous that you weren't there?

Or were you more super-relieved that you were safely far away?

-Oh, my God. I was crawling out of my skin

making phone calls this morning like, "I got to skip Seth.

I got to go back."

But I had to be in New York anyway for my MSNBC show.

We have an awesome team at NBC News,

and so they were out there repping NBC.

I will say this, though. Watching, and we were sort of

on set doing the analysis piece for NBC News for our stations

throughout the day.

There were moments --

That was tense and uncomfortable.

That's not a hot take.

That's, like, a very lukewarm take.

-Yeah. -A press conference

that is not normal for the East Room, necessarily.

But the attacks on the media and the way that he has

these sort of moments and interactions,

that actually does well for him among his supporters,

and that's something to remember,

that that actually plays for him.

Trump's Acting Attorney General Helped Run A Business That Defrauded Inventors - Duration: 3:04.

So Matthew Whitaker who is at present our Acting Attorney General after Donald Trump

kind of forced Jeff Sessions to resign.

We've already talked about the fact that Whitaker is a guy that wants to end the Mueller probe.

He has expressedly said so in an op ed, and actually laid out the blueprint for how he

would do it.

Everybody knows about that part though.

But what a lot of people may not know is that Whitaker is also a professional fraudster.

Last year, even before he joined Jeff Session's staff at the DOJ, an op ed ... Not an op ed,

an article came out explaining just what a fraud Matthew Whitaker truly is.

And here's what happened.

Whitaker sat on the Board of Directors, was getting paid on the Board of Directors of

a company called World Patent Marketing.

World Patent Marketing was one of those places that told inventors out there in the United

States send us your idea.

We're going to help you get patented; we're going to help you get marketing; we're going

to help you make this into the next billion-dollar idea here in the United States.

So thousands of wannabe inventors, wannabe, you know, innovators in the United States,

sent their ideas down to this company, paid them thousands of dollars while Whitaker was

sitting on the board and then they did nothing.

They pocketed these people's money, and they didn't do anything.

They did nothing that they promised.

And we know they did nothing that they promised because that's what came out from a Federal

Trade Commission lawsuit against this company.

So the federal government itself had to step in and sue this company that Whitaker was

on the Board of Directors of because they were scamming consumers.

They were scamming people with good ideas because they themselves didn't have any good

ideas and the only way they knew how to make money was to take advantage of people with

good ideas.

It actually gets even worse than just that.

While on the Board of Directors, there was one inventor who submitted a bad review of

the company to the Better Business Bureau.

Whitaker, on the Board of Directors, sent this guy a letter and said the following,

basically he threatened him.

He said, "I am assuming you understanding that there will be serious civil and criminal

consequences for you."

Understand that we take threats like this quite seriously.

He also used his weight as a former prosecutor to try to get this guy to take down his review

or retract it to the Better Business Bureau.

That's what happened.

Okay, the guy realized he got scammed.

Told the BBB and then Whitaker flies off the handle, sends him a letter threatening him

because he exposed what this company was actually doing.

And ladies and gentlemen, this is the man who as of right now and for the short-term

foreseeable future is going to be our Attorney General of the United States.
