could it could a topic be more pertinent than this one I don't think so professor
thank you very much congratulations Giuliani was on yesterday talking about
how wonderful the book is and we'll get to vadym now the president's reading
your book president's lawyers reading your book you're earning your money
something so but of course we're talking about the president Supreme Court pick
Brett Kavanaugh what do you make well you know he went to Yale Law School and
he taught at Harvard what could be wrong with that he has a lot of support from
centrist academics he's regarded as a very scholarly very smart person I
probably will disagree with many of his opinions but it's hard to question his
qualifications for the job those of us who are Center liberals hope he is more
like Justice Kennedy maybe more like a Chief Justice Roberts then like Justice
Gorsuch but only time will tell you look he'll be on the court 30 40 years we
don't even know what the issues are gonna be 30 40 years from now so a
reasonable reaction that says he's scholarly he's highly respected
wonderful credentials that's not what we heard last night from the left
fighting
we are in the fight of our lives he is hostile to just about anyone I
will be voting no I am not going to kill anybody this is a tough fight but it is
a fight that we did would professor this seems to me the point which is that this
notion there by senator Warren that he's hostile to everyone every race and she
and she knows him they served together on the law school faculty he is not a
hostile person she is obviously saying what her base wants to hear and you know
it what's happened to Supreme Court confirmation battles is just a tragic
you see all this resist and you hear their their statements and their sound
bites and the women's March releasing a press release saying that whoever the
nominee and not even whoever the nominee is they forgot to fill in the name of
the nominated when they hit so put some blame where blame belongs the
Republicans get some blame for this too they didn't allow the Merrick garland
case nomination to come before Congress I think that was a violation of the
spirit of the Constitution and the Democrats are going to fight back and
the losers of the American public because we lose very qualified people to
pollute you would you would acknowledge that in in in bygone eras someone like
Brett would have been confirmed no Scalia got 99 but you know Justice
Ginsburg got 90 some hard votes yeah Willie go through well the Democrats
with some of the Democrats in the red states I think he'll go through so we're
talking about the left and another thing that's become sort of a flashpoint is
this idea of not reforming ice or reforming immigration let's just abolish
the agency created after 9/11 which was supposed to root out terrorists angle
after illegal immigrants here's Cynthia Nixon talking about ice
has strayed so far from its mission it's supposed to be here to keep
Americans safe but what it's turned into is is frankly a terrorist organization
of its own that is terrorizing people who are coming to this country so
there's no nuance there's no hey let's fix this maybe there are some problems
it's let's abolish the folks who are trying to protect
it's outrageous she is the gift that keeps giving to the Republican Party she
is becoming a face of the Democratic extremism the idea calling ice a
terrorist organization this is a woman who supports boycotting Israel which
means supporting real terrorists who are attacking Israel she should understand
what real terrorism is she should go to a cafe in Tel Aviv or a bus that's been
blown up and she supports opposition to Israel through BDS and she's calling an
American institution a terrorist organization it's outrageous and people
should vote against her with enthusiasm particularly if you're a Democrat here's
the White House statement it's deeply disturbing that Cynthia Nixon has no
clue of what I studs to protect Americans and New Yorkers every day from
dangerous criminals terrorists child smugglers and human traffickers well
interesting um another obviously flashpoint we've mentioned we talked
about Supreme Court we talked about this battle over immigration the Mulder
investigation it's out there president wants it to be done with it's gone on
for well over a year and your book takes this on it sort of takes a fresh look at
what is the bar that should be crossed to impeach a president well first of all
in my book I prove that you cannot impeach a president unless he commits a
crime a specified crime while in office and you can't prosecute him while he's
in office that's why we didn't need a special counsel we needed an independent
investigation getting the facts making sure Russia doesn't try to intrude in
our elections again look every other academic in the world practically
disagrees with my conclusion that you need a crime but I go back to the
history I show Hamilton I show Madison and I think I proved conclusively that
impeachment is not just a political act it's a constitutional act and for it to
be satisfying the Constitution you need to prove that the president committed
bribery treason or other high crimes and misdemeanors without that any
impeachment would be unconstitutional so what's your message to Maxine Waters
I have a lot of messages when she says that it's a lawless process she's
reflecting her own ignorance look I posed in this a very dangerous
hypothetical what if the Senate were to remove a president without him
committing a crime and the President refused to leave office as a president
might very well do we'd have a major constitutional crisis and that case
would ultimately get to the United States Supreme Court
so I also argue that impeachment might be reviewable in the United States
Supreme Court which brings together the Kavanagh an appointment to my book about
he made me voting on whether or not a subpoena should be enforced he might be
voting on a lot of issues but remember that when Bill Clinton had his issues
his two appointees voted against him in Japan Nixon's appointees voting the
Kavanagh was helped write the Starr report right eventually now he had you
know he has an open mind he's been thinking back about whether he was right
or wrong look the issue of impeaching or prosecuting a president as I say in this
book is a momentous constitutional event and we have to stick to the Constitution
and I lay out in this book a very persuasive case about what the
Constitution demands Constitution didn't want to make it easy to remove a
president yeah they didn't want the British system where Parliament can
remove a president they wanted specific crimes to have been committed while in
office we're not close to that and I think we're wasting the time and money
if the book is called the case against impeaching Trump check it out
the highest of the high levels are reading this it's probably worth reading
